Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of the Nibbley mobile application and related services ("Service") operated by SevenVectors Ltd, a company registered in England & Wales (Company No. 17191932), with its registered office at Hill House, Warley Wise Lane, Colne, United Kingdom, BB8 7ES.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility

You must be at least 13 years of age to use Nibbley. If you are under 18, you confirm that you have the consent of a parent or guardian. By using the Service, you represent that you meet these requirements.

3. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate and complete information when creating your account.
• You must notify us immediately at team@nibbley.app if you suspect unauthorised access to your account.

4. Use of the Service

Nibbley allows you to save, organise, create, and share recipes. You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service for any illegal or unauthorised purpose.
• Attempt to gain unauthorised access to any part of the Service, other accounts, or systems.
• Upload or transmit viruses, malware, or any harmful code.
• Use automated tools (bots, scrapers) to access the Service without our written permission.
• Interfere with or disrupt the integrity or performance of the Service.
• Reproduce, duplicate, copy, sell, or exploit any portion of the Service without express permission.
• Upload content that is defamatory, obscene, hateful, or infringes on the rights of others.

5. Your Content

"Your Content" means any recipes, images, text, or other materials you create, upload, or save through the Service.

• Ownership — you retain full ownership of Your Content. We do not claim any intellectual property rights over your recipes or uploads.
• Licence to us — by using the Service, you grant us a limited licence to store, process, and display Your Content solely to provide the Service to you (e.g. syncing across devices, displaying in the app).
• Community sharing — if you choose to publish a recipe to the Nibbley community, you grant other users a non-exclusive licence to view and clone that recipe for personal use. You may unpublish at any time.
• Responsibility — you are solely responsible for Your Content and must ensure you have the right to upload it.

6. Subscriptions and Payments

• Nibbley may offer free and paid subscription tiers. Paid features and pricing are displayed in the app.
• Subscriptions are billed through the Google Play Store or Apple App Store. Payment terms are governed by the respective platform's terms.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription through your device's app store settings.
• Refunds are handled by the respective app store in accordance with their refund policies.
• We reserve the right to change pricing with reasonable notice. Price changes will not affect your current billing period.

7. AI-Generated Content

Nibbley uses artificial intelligence to assist with recipe extraction, image generation, and suggestions. You acknowledge that:

• AI-generated content is provided "as is" and may contain inaccuracies.
• You are responsible for reviewing and verifying any AI-generated recipes, nutritional information, or suggestions before use.
• AI-generated content should not be relied upon for dietary, medical, or allergy-related decisions without independent verification.
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content.

8. Intellectual Property

The Service, including its design, branding, code, features, and documentation (excluding Your Content), is owned by SevenVectors Ltd and protected by UK and international intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

"Nibbley" and the Nibbley logo are trademarks of SevenVectors Ltd. You may not use them without our prior written consent.

9. Availability and Changes

• We aim to keep the Service available at all times but do not guarantee uninterrupted access. Maintenance, updates, or circumstances beyond our control may cause temporary downtime.
• We may modify, update, or discontinue features of the Service at any time. Where changes materially affect your use, we will provide reasonable notice.
• We reserve the right to discontinue the Service entirely with 30 days' notice, during which time you may export your data.

10. Termination

• You may delete your account at any time through the app settings. Upon deletion, your data will be permanently removed within 30 days.
• We may suspend or terminate your account if you breach these Terms, with or without notice depending on the severity of the breach.
• Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (e.g. limitation of liability, governing law) will continue to apply.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
• SevenVectors Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or £50, whichever is greater.
• Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless SevenVectors Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any third-party rights.

13. Third-Party Services

The Service may integrate with or link to third-party services (e.g. Google Play, Apple App Store, social media platforms for recipe import). We are not responsible for the content, policies, or practices of third-party services. Your use of such services is governed by their respective terms.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you retain any mandatory consumer protection rights afforded to you by the law of your country of residence.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the app or email at least 14 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
